Withdraw from Contract
The following General Terms and Conditions apply to orders placed with WTB Wagner Technik Berlin via our website.
Section 1 Scope
The following General Terms and Conditions, in the version valid at the time of the order, apply to the business relationship between WTB Wagner Technik Berlin and the customer for orders placed via our website.
Section 2 Conclusion of Contract
The presentation of our products on our website does not constitute a legally binding offer, but an invitation to the customer to submit an offer to conclude a contract.
By submitting an order, the customer makes a binding offer to conclude a purchase contract. Immediately after receipt of the order, the customer will receive an electronic confirmation that the order has been received. This confirmation of receipt does not constitute acceptance of the contractual offer unless expressly stated otherwise.
The contract is concluded when we accept the customer's offer within two business days by sending an order confirmation in text form or by dispatching the ordered goods within this period.
For the purposes of these General Terms and Conditions, business days are Monday to Friday, excluding public holidays at our registered place of business.
Section 3 Delivery, Shipping Costs and Transfer of Risk
Delivery will be made to the delivery address specified by the customer. The applicable shipping costs will be displayed to the customer before the order is completed.
In the case of consumers, the risk of accidental loss or accidental deterioration of the goods generally passes to the consumer only upon delivery of the goods. Statutory exceptions remain unaffected.
If the customer is a business customer, the risk passes to the customer as soon as the goods have been handed over to the freight forwarder, carrier or other person designated to carry out the shipment.
Section 4 Retention of Title
The delivered goods remain our property until the purchase price has been paid in full.
Section 5 Payment
We accept the payment methods displayed to the customer during the ordering process.
Section 6 Liability for Defects
The statutory rights relating to liability for defects apply.
Section 7 Information on Electronic Commerce
Input errors:
Before submitting the order, input errors can be identified and corrected using the correction and modification options provided during the ordering process.
Product characteristics and offers:
The essential characteristics of the goods offered and, where applicable, the validity period of limited offers are stated in the respective product descriptions.

Contract text:
Information regarding the storage and accessibility of the contract text is provided to the customer during the ordering process.

Section 8 Applicable Law
The contractual relationship between us and the customer is governed by the law of the Federal Republic of Germany.
If the customer is a consumer, mandatory statutory provisions of the country in which the consumer has their habitual residence, from which no contractual derogation is permitted, remain unaffected.
The United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.
The following information explains the statutory right of withdrawal available to consumers in connection with distance contracts.
Right of Withdrawal
Consumers have the right to withdraw from a distance contract concluded with us within fourteen days without giving any reason.
The withdrawal period is fourteen days.
For a single delivery of goods, the withdrawal period begins on the day on which you, or a third party designated by you who is not the carrier, receives the goods.
If you order several goods as part of one order and they are delivered separately, the withdrawal period begins when the last item is received.
If goods are delivered in several partial shipments or pieces, the withdrawal period begins when the final shipment or piece is received.
Exercising Your Right of Withdrawal
To exercise your right of withdrawal, you must inform us by means of a clear statement that you wish to withdraw from the contract.

Additional delivery costs resulting from your choice of a delivery method other than our least expensive standard delivery option will not be reimbursed.
Reimbursement will be made without undue delay and no later than fourteen days after the day on which we receive your notice of withdrawal.
We will normally use the same means of payment that you used for the original transaction unless expressly agreed otherwise. You will not incur any additional fees as a result of the reimbursement.

The right of withdrawal does not apply in particular to contracts for the supply of goods that are not prefabricated and are made on the basis of an individual choice or specification by the consumer, or which are clearly tailored to the consumer's individual requirements.
